SCRTRARE Terms of Service and Sale
1. Agreement to These Terms
These Terms of Service and Sale (“Terms”) govern your access to and use of SCRTRARE, including: • scrtrare.com; • beta.scrtrare.com; • Customer accounts; • Shopping carts; • Buy Now purchases; • Offers and counteroffers; • Payments; • Shipping and tracking; • Returns, refunds, and resolutions; and • Related communications and support.
“SCRTRARE” refers to the business operating scrtrare.com and selling the products offered through the Service.
By creating an account, placing an order, submitting or accepting an offer, or otherwise using a transaction feature, you agree to these Terms and any Return, Refund, Shipping, or Trade-In Policy expressly presented for the transaction.
Our Privacy Policy explains how SCRTRARE handles personal information. By using SCRTRARE, you acknowledge that you have had an opportunity to review it.
The version of these Terms and related policies presented at the time of a transaction governs that transaction.
2. Eligibility and Purchases for Minors
You must be at least 18 years old and have legal capacity to create an account, submit or accept an offer, or place an order.
A person under 18 may browse SCRTRARE, but any purchase for or on behalf of a minor must be made by a parent or legal guardian who: • Is at least 18 years old; • Uses the adult’s own SCRTRARE account; • Uses a payment method the adult is authorized to use; and • Accepts these Terms as the purchaser.
By using a transaction feature, you represent that: • You satisfy the applicable age and capacity requirements; • The information you provide is accurate and complete; • You are authorized to use the selected payment method; • You are not using SCRTRARE for fraud or another unlawful purpose; and • Your transaction does not violate a legal obligation applicable to you.
3. Accounts and Account Security
SCRTRARE may permit account access through: • An email sign-in link; • Google sign-in; or • Sign in with Apple.
You are responsible for maintaining control of: • Your email account; • Your Google or Apple account; • Devices used to access SCRTRARE; • Active browser sessions; and • Other account-access credentials.
Promptly contact support@scrtrare.com if you suspect: • Unauthorized account access; • Unauthorized use of a payment method; • An unknown order or offer; • Compromise of your email or sign-in provider; or • Another security problem.
You must provide accurate information and keep your contact information reasonably current.
You may request account closure by emailing privacy@scrtrare.com. Account closure does not automatically cancel or eliminate: • An accepted order; • An accepted binding offer; • A payment obligation; • A shipment already in progress; • A return, refund, or dispute; or • Records SCRTRARE must or reasonably needs to retain.
4. SCRTRARE’s Role
SCRTRARE is the direct seller of the collectible items listed on the website.
SCRTRARE is not a customer-to-customer marketplace. Unless a separate written policy and transaction-specific agreement expressly state otherwise, SCRTRARE does not provide: • Customer product listings; • Customer-to-customer sales; • Auctions; • Consignment; • Brokerage services; or • Public customer collections.
If SCRTRARE introduces a trade-in program, the transaction will also be governed by the Trade-In Policy and written trade offer presented to the customer.
5. Product Listings and Graded Collectibles
SCRTRARE primarily sells individually identified collectible trading cards encapsulated and graded by an identified independent grading company.
Unless a listing clearly states that an image is representative, listing photographs are intended to show the actual item being sold.
The item is identified collectively by: • Product title; • Card identity; • Set, number, language, and variant; • Grading company; • Grade; • Certification number; • Holder or slab; • Listing photographs; and • Written description.
SCRTRARE will not knowingly substitute a different certification number or materially different item without your affirmative agreement.
If a listing contains a material conflict among its title, description, images, grade, or certification number, SCRTRARE may correct the listing or cancel the transaction. If SCRTRARE cancels a paid transaction before shipment because of a material listing error, SCRTRARE will issue a refund to the original payment method.
Independent Grading A grading company’s assigned grade is that company’s independent opinion. SCRTRARE does not guarantee: • That another grading company would assign the same grade; • That the item would receive the same grade if removed from its holder and resubmitted; • That population-report information will remain unchanged; • That a grading company will not revise its standards or records; • That an item will increase or maintain its value; or • Any particular resale result.
The assigned card grade may not describe every cosmetic characteristic of the outer holder. Material holder damage known to SCRTRARE should be disclosed through the listing text or photographs.
Third-party names, card artwork, publishers, grading companies, leagues, characters, and trademarks are used to identify products. Unless expressly stated, their appearance does not imply sponsorship, endorsement, or affiliation with SCRTRARE.
6. No Investment or Appraisal Advice
Collectible values may increase or decrease and can be volatile.
SCRTRARE does not provide investment, financial, tax, legal, insurance, or appraisal advice.
Prices, population information, comparable sales, market information, and collectible commentary are provided only for shopping and general informational purposes.
SCRTRARE does not guarantee: • Future value; • Appreciation; • Resale price; • Liquidity; • Market demand; • A future grading result; or • Any return on a purchase.
7. Shopping Carts, Availability, and Reservations
Placing an item in a shopping cart does not reserve it.
An item remains available to other customers until SCRTRARE records an accepted purchase or inventory reservation through the applicable transaction process.
Because many SCRTRARE products are unique, an item may become unavailable while appearing in a cart or while payment is being attempted.
Before completing a transaction, SCRTRARE may verify: • Item identity; • Price; • Inventory availability; • Shipping address; • Applicable policy version; • Payment status; and • Fraud or security information.
SCRTRARE does not guarantee that an item displayed on the website will remain available.
8. Buy Now Orders
Submitting a Buy Now order and payment information is an offer to purchase the identified item at the displayed price and charges.
A Buy Now transaction is accepted when: • Payment is successfully completed or confirmed; • SCRTRARE reserves the identified inventory; and • SCRTRARE sends or displays an order confirmation.
A message acknowledging a payment attempt does not necessarily mean the payment succeeded or that the order was accepted.
SCRTRARE may decline or cancel an order because of: • Unavailable or duplicate-sold inventory; • An obvious or material pricing or listing error; • An invalid or ineligible shipping address; • Failed, reversed, or unverifiable payment; • Suspected fraud or unauthorized payment; • A security or legal concern; or • A technical error preventing transaction completion.
If SCRTRARE cancels an order after successfully collecting payment, SCRTRARE will void the payment or refund the collected amount to the original payment method.
SCRTRARE will not replace the purchased item with another item without your affirmative agreement.
9. Offers and Counteroffers
Certain items may permit customers to submit offers.
A. Binding Offers
By submitting an offer, you make a binding offer to purchase the identified item at the offered price until the offer: • Expires; • Is rejected; • Is replaced by a counteroffer; or • Is canceled with SCRTRARE’s written confirmation before acceptance.
The applicable offer period will be displayed before submission.
A cancellation request is not effective unless SCRTRARE confirms it before accepting the offer.
B. Acceptance, Rejection, and Counteroffers
SCRTRARE may: • Accept an offer; • Reject an offer; • Permit it to expire; or • Send a counteroffer.
Unless expressly stated otherwise, a counteroffer rejects and replaces the previous offer.
A counteroffer does not bind you unless you affirmatively accept it before it expires.
C. Saving and Charging a Payment Method
When you submit an eligible offer or accept a counteroffer, you authorize Stripe to save the selected payment method for that particular offer.
You also authorize SCRTRARE to initiate one payment using that method if SCRTRARE accepts the offer before it expires.
The authorized payment will equal: Accepted merchandise price plus disclosed shipping charges plus applicable tax minus any expressly disclosed discount or credit.
SCRTRARE pays the cost of merchandise-value shipping insurance unless a different arrangement is clearly disclosed and affirmatively accepted before the transaction.
The payment may be initiated when you are not actively using the website.
This authorization: • Applies only to the specific offer or accepted counteroffer; • Permits only one resulting purchase payment; • Is not a subscription; • Is not recurring-payment authorization; and • Does not authorize charges for unrelated purchases.
Your bank or payment provider may require additional authentication. If required authentication is not completed within the stated period, SCRTRARE may cancel the transaction and release the inventory reservation.
If the payment is declined, fails, cannot be authenticated, or cannot be confirmed, SCRTRARE may cancel the purchase and return the item to available inventory.
10. Prices, Payment, and Taxes
All prices are in U.S. dollars unless expressly stated otherwise.
Available payment methods may vary based on the transaction, payment amount, device, or payment-provider requirements.
Stripe processes complete payment credentials through its embedded payment interface. SCRTRARE does not store complete card numbers or card-security codes.
Your bank or payment provider may: • Place an authorization hold; • Require identity or transaction authentication; • Decline a transaction; • Apply its own processing period; or • Display a pending transaction before payment becomes final.
SCRTRARE may delay fulfillment until payment has successfully completed.
The merchandise price, shipping charge, applicable tax, and total will be displayed before you complete a Buy Now order or accept a counteroffer.
SCRTRARE may change prices and shipping rates for future transactions. A later price change will not alter an already accepted purchase.
Refunds are issued to the original payment method unless applicable law requires otherwise. Financial institutions may require additional time to post a refund. Nothing in these Terms prevents a customer from making a truthful support request or exercising a lawful payment-dispute right. Knowingly submitting fabricated information or attempting to retain both the merchandise and its purchase price is prohibited.
11. Shipping and Delivery
SCRTRARE ships only to eligible, provider-verified addresses within the United States.
Available destinations and shipping charges are displayed during checkout. SCRTRARE may decline an address because of: • Address-verification failure; • Carrier limitations; • Tax or legal restrictions; • Fraud or security concerns; or • Other restrictions disclosed during checkout.
You are responsible for providing a complete and accurate shipping address.
An address-change request is not effective unless SCRTRARE confirms the change in writing. SCRTRARE may decline a change after fulfillment has begun.
SCRTRARE may require signature confirmation based on order value, destination, or fraud risk.
A. Processing Time
SCRTRARE typically tenders accepted and fully paid orders to the carrier within three business days after successful payment.
Processing may take up to seven business days.
For an accepted offer, the processing period begins when the resulting payment has successfully completed.
A “business day” means Monday through Friday, excluding federal holidays and days on which the applicable carrier is not operating.
If SCRTRARE cannot tender the order to a carrier within seven business days, SCRTRARE will provide a delay notice and any legally required opportunity to consent to the revised shipment date or cancel for a refund.
B. Transit and Tracking
SCRTRARE will provide tracking information when available.
Creating a shipping label does not necessarily mean that the carrier has accepted the package.
Carrier transit and delivery dates begin after carrier acceptance and are estimates unless a service is expressly identified as guaranteed.
Carrier delays may result from: • Weather; • Service interruptions; • Emergencies; • Address issues; • Delivery-access problems; or • Other conditions outside SCRTRARE’s reasonable control.
C. Insurance and Risk of Loss
SCRTRARE pays for merchandise-value shipping insurance unless otherwise clearly disclosed.
Unless applicable law requires otherwise, risk of loss remains with SCRTRARE until carrier-confirmed delivery to the shipping address provided for the order.
After carrier-confirmed delivery, risk of loss transfers to the purchaser, except for a valid claim involving an incorrect item, material undisclosed damage, package tampering, or another Approved Claim described below.
12. Final Sales and Limited Return Remedies
Except for an Approved Claim or where otherwise required by law, all SCRTRARE sales are final.
SCRTRARE does not accept discretionary returns, exchanges, or refund requests based on: • Buyer’s remorse or a change of mind; • Changes in market price or collectible value; • Finding the same or a similar item elsewhere for a different price; • Disagreement with the grade or opinion assigned by an independent grading company; • A desire to submit the item to another grading company; • Characteristics clearly shown or disclosed before purchase; • Minor photographic, lighting, display, or magnification differences that do not make the item materially different from the listing; or • Damage occurring after carrier-confirmed delivery.
A. Approved Claims
An “Approved Claim” may arise when: • The order is not delivered; • SCRTRARE sends a different item, grade, certification number, variant, language, or product from the purchased listing; • The item is counterfeit; • The certification is invalid; • The slab has material undisclosed evidence of tampering; • The item has material damage that was not shown or disclosed before purchase; • The item is materially different from its listing; or • A remedy is otherwise required by applicable law.
A subjective disagreement with a grading opinion, market value, or characteristic plainly visible in the listing is not an Approved Claim.
B. Reporting a Problem
Visible shipping damage or suspected package tampering should be reported within 48 hours after carrier-confirmed delivery.
An incorrect or materially not-as-described item should be reported within three calendar days after carrier-confirmed delivery.
A suspected counterfeit or invalid certification that could not reasonably have been identified during the initial inspection period must be reported promptly after discovery.
Send claims to support@scrtrare.com.
Include: • Your name; • Order number; • Item certification number; • A detailed description of the problem; • Clear photographs; • The continuous unboxing video described below, when available; • Photographs of the box, shipping label, seals, packaging, slab, and item; and • Other relevant supporting information.
These reporting periods do not eliminate any right that applicable law does not permit SCRTRARE to restrict.
C. Continuous Unboxing Video
Customers should record a single, continuous, unedited video when opening an SCRTRARE delivery.
The video should: • Begin before the outer package is opened; • Clearly show the shipping label; • Show all sides of the package; • Show the condition of the package and seals before opening; • Keep the package, contents, and the customer’s hands continuously visible; • Contain no cuts, pauses, edits, filters, or hidden periods; • Show removal of all internal packaging; • Clearly show the item’s front, back, holder, certification number, and any claimed discrepancy or damage; and • Continue until the item and packaging have been fully documented.
A continuous video is particularly important for claims involving: • Package tampering; • Missing contents; • An incorrect item; • Visible transit damage; or • A discrepancy between the package and its stated contents.
The absence of a continuous video may materially limit SCRTRARE’s ability to verify a claim and may result in denial when the claim cannot otherwise be reliably established.
SCRTRARE will nevertheless consider other reliable evidence and will not use the absence of one particular type of evidence to eliminate a right that applicable law does not permit SCRTRARE to waive.
D. Preserving Evidence
Keep the item, outer box, internal packaging, labels, seals, and included materials in their received condition until SCRTRARE completes its review.
Do not: • Remove the card from its graded holder; • Open, crack, or alter the holder; • Clean, polish, repair, or modify the holder or item; • Remove labels or security features; or • Return the item without written authorization.
Alteration may prevent SCRTRARE from verifying the claim.
13. Cancellation
Orders may enter fulfillment shortly after acceptance.
You may request cancellation before shipment by contacting support@scrtrare.com, but SCRTRARE does not guarantee that a cancellation request can be completed after an order is submitted.
An order cannot be canceled after carrier acceptance.
SCRTRARE may cancel an order before shipment because of: • Duplicate sale of a unique item; • Inventory error; • Material pricing or listing error; • Failed or reversed payment; • Suspected fraud; • Invalid shipping information; • Legal or tax restrictions; or • Another material compliance or security issue.
If SCRTRARE cancels a paid order, SCRTRARE will void or refund the payment to the original payment method.
14. Trade-Ins
SCRTRARE does not operate a customer-to-customer trading marketplace.
When SCRTRARE expressly offers to accept an item as a trade-in, the trade will be governed by: • The SCRTRARE Trade-In Policy; • The written preliminary trade offer; • Any transaction-specific disclosures; and • These Terms.
A preliminary trade valuation is not a final acceptance unless the applicable Trade-In Policy and written offer expressly state otherwise.
15. Transactional Communications
By creating an account, submitting an offer, or placing an order, you consent to receive electronic communications concerning: • Account authentication; • Account security; • Offers and counteroffers; • Payment or payment authentication; • Orders and receipts; • Shipping and tracking; • Delivery; • Returns and refunds; • Support and resolutions; and • Legal or policy notices affecting a transaction.
These are transactional communications and are not a marketing subscription.
You are responsible for maintaining a current email address and reviewing communications associated with your account.
16. Acceptable Use
You may not: • Provide a false identity, address, ownership claim, or payment method; • Use a payment method without authorization; • Submit a fabricated return, damage, non-delivery, or not-as-described claim; • Manipulate photographs, videos, packaging, tracking information, or transaction evidence; • Access or attempt to access another customer’s account; • Circumvent authentication, rate limits, fraud controls, invitations, or security measures; • Use bots or automated systems to interfere with inventory or purchasing; • Scrape private customer, transaction, or administrative information; • Introduce malware or harmful code; • Conduct credential attacks or denial-of-service activity; • Infringe intellectual-property or privacy rights; • Reverse engineer the service except where applicable law expressly permits it; or • Use SCRTRARE for unlawful activity.
This section does not prohibit a customer from making a truthful support request, submitting a good-faith claim, exercising a lawful consumer right, or making a legitimate payment dispute.
17. Intellectual Property
SCRTRARE’s original website text, design, branding, logos, software, product photographs, organization, and original content are owned by SCRTRARE or used with permission.
SCRTRARE grants you a limited, personal, non-exclusive, non-transferable, and revocable right to use the website for lawful personal shopping and account purposes.
You may not reproduce, distribute, sell, commercially exploit, or create derivative works from SCRTRARE content without permission, except where permitted by law.
Third-party card artwork, characters, publishers, grading-company marks, league marks, and other intellectual property remain the property of their respective owners.
Information You Submit You retain any rights you have in photographs, videos, messages, claim evidence, and other information you submit. You grant SCRTRARE a limited, non-exclusive license to store, copy, review, transmit, and use that information as reasonably necessary to: • Process an order or offer; • Provide support; • Investigate a claim; • Prevent fraud; • Enforce these Terms; and • Comply with law.
This license does not authorize SCRTRARE to use private claim or transaction content for unrelated advertising.
18. Service and Third-Party Disclaimers
To the maximum extent permitted by law, website and non-transactional features are provided on an “as available” basis.
SCRTRARE does not guarantee that: • The website will always be uninterrupted or error-free; • Every feature will remain available; • A third-party sign-in, payment, shipping, analytics, or communications service will operate without interruption; • Carrier estimates will be met; • Third-party grading information will never change; or • A collectible will maintain or increase its value.
Nothing in this section disclaims: • An express factual product representation in an accepted listing; • SCRTRARE’s obligation to provide the purchased item or an applicable refund; • Liability that cannot lawfully be disclaimed; or • A consumer right that applicable law does not permit SCRTRARE to waive.
19. Limitation of Liability
To the maximum extent permitted by law, SCRTRARE will not be liable for indirect, incidental, special, exemplary, or consequential damages, including: • Lost resale opportunities; • Lost anticipated profits; • Changes in collectible or market value; • A customer’s investment decision; or • Losses caused by a service interruption outside SCRTRARE’s reasonable control.
For a claim arising from a particular purchase, SCRTRARE’s aggregate liability will not exceed the amount paid to SCRTRARE for that purchase, except where applicable law requires a different remedy.
These limitations do not apply to: • Fraud; • Willful misconduct; • Gross negligence where it cannot lawfully be limited; • Liability for which exclusion is prohibited; or • A non-waivable consumer remedy.
20. Account Suspension and Termination
SCRTRARE may restrict, suspend, or terminate an account or transaction feature when reasonably necessary because of: • Fraud or suspected fraud; • Unauthorized payment; • Security risk; • False or misleading information; • Abuse of offers, refunds, returns, or disputes; • Violation of these Terms; • Legal requirements; or • Harm to customers, SCRTRARE, or third parties.
SCRTRARE may place an order or account under review while investigating fraud or security concerns.
When reasonably possible, accepted and paid orders will be fulfilled or resolved under the applicable transaction terms despite an account restriction.
Provisions concerning payment, shipping, returns, disputes, intellectual property, liability, and record retention survive account closure.
21. Informal Dispute Resolution
Before filing a lawsuit concerning these Terms or a transaction, you and SCRTRARE agree to make a good-faith effort to resolve the dispute informally.
Send a description of the dispute, the applicable order number, requested resolution, and supporting information to support@scrtrare.com.
The parties will have 30 days after receipt to attempt to resolve the dispute.
This requirement does not prevent either party from: • Responding to a payment dispute; • Seeking urgent injunctive relief; • Making a legally required filing; • Reporting suspected unlawful conduct; or • Bringing an eligible matter in small-claims court.
22. Governing Law and Venue
These Terms are governed by the laws of the State of Illinois, without regard to conflict-of-law principles.
Subject to non-waivable consumer rights and the small-claims exception, legal proceedings concerning these Terms or SCRTRARE must be brought in the state or federal courts serving Cook County, Illinois.
Nothing in this section deprives a consumer of a mandatory protection or forum right that applicable law does not permit SCRTRARE to waive.
These Terms do not require mandatory arbitration and do not contain a class-action or jury-trial waiver.
23. Changes to These Terms
SCRTRARE may update these Terms prospectively.
Updated Terms will be posted with a revised effective date. Material changes will not retroactively alter a completed purchase or previously submitted offer unless: • Both parties agree; • The change benefits the customer without imposing a material new obligation; or • Applicable law requires the change.
A transaction remains governed by the version presented for that transaction.
24. General Provisions
Entire Agreement These Terms, the applicable order confirmation, and the policies incorporated into the transaction constitute the agreement concerning that transaction.
Severability If a provision is held invalid or unenforceable, it will be enforced to the maximum extent permitted, and the remaining provisions will remain effective.
No Waiver A delay or failure to enforce a provision does not waive the right to enforce it later.
Assignment You may not assign an account, offer, or transaction without SCRTRARE’s written consent. SCRTRARE may assign these Terms in connection with formation of the planned LLC, a merger, acquisition, financing, reorganization, or sale of the relevant business or assets, subject to applicable law.
Events Outside Reasonable Control SCRTRARE is not responsible for delays caused by events outside its reasonable control, including severe weather, natural disasters, carrier interruptions, government actions, infrastructure failure, labor disruption, or widespread payment-network failure. This provision does not eliminate any legally required delay notice, cancellation right, or refund obligation.
Headings Section headings are for convenience and do not change the meaning of these Terms.
